Unless otherwise expressly stated, all original written, visual, audio, audiovisual, and other creative works appearing on this website or otherwise published, distributed, displayed, or made available by M. D. Eaton are protected by applicable copyright and other intellectual-property laws.

This includes, without limitation, all books, manuscripts, stories, poetry, essays, articles, blog posts, criticism, educational materials, lesson materials, scripts, screenplays, short films, videos, photographs, illustrations, artwork, graphics, designs, logos, characters, fictional worlds, titles, written descriptions, recordings, audio works, and other original creative materials, whether published or unpublished and whether presented in whole or in part.

1. Reservation of Rights

All rights are expressly reserved.

Except where a specific use is expressly authorized by M. D. Eaton in writing or is otherwise permitted by applicable law, no person or entity may reproduce, distribute, publicly display, publicly perform, transmit, publish, modify, adapt, translate, create derivative works from, sell, license, commercialize, or otherwise exploit any protected material.

The absence of a copyright notice on an individual work does not constitute permission to use that work.

2. No Permission for Artificial-Intelligence Training

No work covered by this policy is authorized for use in training, developing, fine-tuning, testing, evaluating, validating, benchmarking, or otherwise improving any artificial-intelligence, machine-learning, generative-AI, large-language-model, multimodal-AI, computer-vision, image-generation, audio-generation, video-generation, or other computational model or system.

This prohibition applies to the use of M. D. Eaton’s works for:

  • training artificial-intelligence or machine-learning models;

  • creating or expanding datasets, corpora, or training datasets;

  • pre-training or post-training AI systems;

  • fine-tuning or adapting AI models;

  • reinforcement learning or related optimization processes;

  • developing embeddings, vectors, representations, or other machine-readable model inputs;

  • evaluating or benchmarking AI systems where my works are incorporated into the evaluation or development dataset;

  • developing systems capable of generating text, images, artwork, music, audio, video, or other content based upon or informed by my works;

  • developing systems intended to imitate, reproduce, emulate, or approximate my writing, artistic style, characters, fictional worlds, visual works, or other creative expression; and

  • any substantially similar present or future use involving computational systems intended to learn from, reproduce, analyze for model-development purposes, or generate content from my copyrighted works.

No license, permission, authorization, consent, or other grant of rights for any such AI or machine-learning use is provided by the publication or accessibility of these works online.

3. Prohibition on Automated Collection for AI Purposes

The availability of M. D. Eaton’s works on a publicly accessible website does not constitute permission for automated systems to copy, scrape, crawl, download, ingest, index, store, reproduce, or otherwise collect those works for the purpose of artificial-intelligence or machine-learning development.

This prohibition applies regardless of whether the collection occurs through:

  • web scraping;

  • automated crawlers, spiders, bots, agents, or other software;

  • APIs;

  • bulk downloading;

  • dataset construction;

  • automated archiving;

  • text or data mining;

  • image harvesting;

  • content aggregation;

  • third-party databases;

  • search or retrieval systems;

  • browser automation;

  • publicly accessible webpages;

  • repositories or content-hosting services; or

  • any other automated or substantially automated means.

Technical accessibility does not constitute authorization.

4. No Implied AI License

Nothing on this website, in any publication, or in any other distribution of M. D. Eaton’s work shall be interpreted as granting an express or implied license to use my copyrighted material for artificial-intelligence training or development.

In particular, public availability, accessibility without a login, indexing by a conventional search engine, or the absence of technical restrictions shall not be interpreted as consent to AI training or dataset inclusion.

Any license for AI-related use must be separately and expressly negotiated and granted in writing by the copyright owner.

5. Text, Literary, and Written Works

This restriction applies to all written materials, including but not limited to:

  • books and portions of books;

  • novels and short stories;

  • poetry;

  • essays;

  • blog posts and articles;

  • reviews and criticism;

  • manuscripts;

  • educational and instructional materials;

  • scripts and screenplays;

  • fictional characters and settings;

  • descriptions and narrative passages;

  • unpublished works; and

  • excerpts or portions of any of the foregoing.

No such material may be incorporated into an AI training corpus, language-model dataset, retrieval corpus, synthetic-data pipeline, or comparable machine-learning resource without express written authorization.

6. Visual Art and Images

All original artwork and visual materials are likewise protected.

This includes, without limitation:

  • illustrations;

  • paintings;

  • drawings;

  • photographs;

  • digital artwork;

  • graphic designs;

  • book-cover artwork;

  • character designs;

  • concept art;

  • diagrams;

  • logos and visual marks;

  • promotional artwork;

  • environmental artwork;

  • visual compositions; and

  • other original visual works.

No such work may be copied, ingested, processed, stored, or incorporated into a dataset for training, fine-tuning, developing, testing, or improving an AI image-generation, computer-vision, multimodal, or other machine-learning system without express written authorization.

7. Audio, Video, and Film

This policy also applies to audiovisual works, including short films, videos, recordings, performances, sound recordings, scripts, and associated visual or audio materials.

Such materials may not be used to train, fine-tune, test, develop, or improve systems capable of generating or manipulating text, images, voices, music, sound, video, performances, or other audiovisual content without express written permission.

8. Style, Characters, and Creative Identity

The restriction described above includes unauthorized computational use of my works for the purpose of developing systems intended to reproduce, imitate, or substantially approximate my creative expression, including my writing, artistic methods, recurring characters, fictional settings, narrative worlds, or other distinctive creative elements.

Nothing in this provision is intended to claim ownership over ideas, concepts, facts, general artistic techniques, or other subject matter that is not independently protected by copyright. It is intended to reserve the rights applicable to my protected expression and to make clear that I do not voluntarily authorize the use of these works as source material for AI-system development.

9. Human Reading and Lawful Uses

This policy does not prohibit ordinary human activities that are otherwise lawful, such as reading, viewing, listening to, discussing, quoting limited portions where legally permitted, or linking to my publicly available work.

Nothing in this notice is intended to restrict rights that cannot lawfully be restricted, including applicable limitations and exceptions under copyright law.

Any permitted use, however, should not be interpreted as a broader license to reproduce or exploit my work for unrelated purposes.

10. No Waiver

Failure to identify, detect, or immediately object to an unauthorized use does not constitute consent, permission, waiver, abandonment, or relinquishment of any copyright or other intellectual-property right.

All rights are reserved regardless of whether an infringement or unauthorized use is discovered immediately or at a later date.

11. Third-Party Platforms and Services

Where these works are distributed through third-party websites, publishers, bookstores, social-media platforms, video platforms, archives, or other services, this notice applies to my rights to the extent applicable.

The terms of a third-party platform do not independently grant permission from me for uses that I have not authorized, except to the extent that I have expressly agreed to such terms or the law otherwise provides.

12. Permission and Licensing

Requests for permission to reproduce, publish, license, adapt, distribute, display, perform, or otherwise use my copyrighted works should be submitted directly to the copyright owner.

Requests involving artificial intelligence, machine learning, dataset creation, automated content collection, or model development must specifically identify the proposed use, the materials involved, the intended system or organization, and the scope and duration of the requested license, or will thus not be considered.

No permission for AI training or model development should be inferred from the mere availability of my works online.

13. Enforcement

Unauthorized use of copyrighted material may constitute copyright infringement or otherwise violate applicable law.

Where appropriate, I reserve the right to pursue any remedies available under applicable law, including requests for removal or disabling of unauthorized copies, claims for damages or other monetary relief where available, injunctive relief, and any other remedies available to a copyright owner.

Nothing in this statement limits any rights or remedies otherwise available to me under applicable law.

14. Future Technologies

This policy applies not only to technologies currently described as "artificial intelligence" or "machine learning," but also to substantially similar future technologies whose function includes learning from, analyzing for model development, reproducing, generating from, or otherwise computationally exploiting copyrighted creative works. Neither does the terminology used by technology companies to describe a system determine whether this prohibition applies.

15. Scope

This notice applies to all protected works made available by M. D. Eaton, whether appearing on this website, in books, publications, social-media accounts, portfolios, repositories, educational materials, films, recordings, exhibitions, or other physical or digital media, unless a particular work is expressly accompanied by a different license or permission statement.

Where a separate license expressly grants particular rights, that license controls only to the extent of the rights expressly granted for that work. All other rights will remain reserved.
